The legal age to bet on horse racing is 18 years old. If you are under 18 and place a bet, and the track finds out about it, you are likely to be permanently removed from the track as the Gaming Commission will penalize the track operator responsible for allowing it to happen.

N.Y. Comp. Codes R. & Regs. Tit. 9 § 4003.39

The first violation for the track will result in a fine of $1,000.

The second violation within one year increases the fine to $5,000.

The third violation within the same timeframe results in a fine of $10,000

The fourth violation within one year results a fine of $25,000.

If you use a fake id to try and place a bet at the track, you may face a felony for criminal possession of a forged instrument, a class D felony, punishable by up to 7 years in prison.
