LaMarche Safranko Law PLLC recently had an important verdict in Albany County Court. On Friday July 22, 2016 a jury found our client not guilty of Attempted Murder and Assault charges.
The prosecution claimed that our client shot a person 5 times who was attempting to steal an ATV on property next to our client’s home in November of 2014 in the Town of Colonie.
The client was subsequently indicted on one count of Attempted Murder in the Second Degree and one count of Assault in the First Degree. In total, the charges carried a maximum prison sentence of 25 years.
The trial began on July 19, 2016 in Albany County Court in front of the Honorable Stephen W. Herrick. At trial, the prosecution called a total of 17 witnesses in an attempt to prove their case. But after a 1 week trial, the jury deliberated for roughly five hours before rendering their decision. When the 12 jurors returned, they returned a verdict of not guilty of Attempted Murder in the Second Degree and not guilty of Assault in the First Degree.
